Below are the Terms and Conditions of your relationship with Peaks and Palms Travel Consultants, LLC. By consulting with or booking through us, you agree that you have read and reviewed these terms and conditions, and that you agree to be bound by them throughout the duration of your relationship with us. These Terms and Conditions (“Agreement”) govern the relationship between Peaks And Palms Travel Consultants, LLC (“Peaks And Palms,” “we,” “us,” or “our”) and you (“Client,” “you,” or “your”). By engaging our services, you agree to comply with and be bound by these terms. If you do not agree with any part of this Agreement, you must refrain from using our services.
This is a legal document and affects your legal rights and remedies. If you have any questions about the contents of this document, we advise that you consult with your attorney.
1.1 “Services” refers to all travel consulting services provided by Peaks And Palms, including but not limited to itinerary planning, booking accommodations, transportation, and activities.
1.2 “Client” refers to any individual or entity that engages our Services.
1.3 “Travel Products” includes but is not limited to flights, hotels, tours, and other travel-related services booked through Peaks And Palms.
1.4 “Third-Party Suppliers” refers to any external companies, organizations, or individuals from whom we procure Travel Products for our Clients.
2.1 Peaks And Palms provides travel consulting services designed to assist Clients in planning and executing travel arrangements tailored to their preferences and requirements. Explicitly, Peaks And Palms facilitates arrangements for their clients with independent Third-Party Suppliers of travel. Peaks And Palms is not a supplier of travel and does not own, operate, or provide travel services, and therefore cannot assume any liability for the performance or lack thereof of those suppliers.
2.2 All Services are rendered on a best-efforts basis. While we strive to meet your expectations, we cannot guarantee specific outcomes, prices, or availability of Travel Products, as they are subject to the policies and availability of Third-Party Suppliers. Explicitly, as pricing and inventory changes constantly, quoted prices are not guaranteed until booked and secured with a deposit or other required payment as outlined by each individual Third-Party Supplier. Peaks And Palms cannot accept any liability for actions taken on unconfirmed quotes.
2.3 Our Services may include, but are not limited to:
Destination selection and itinerary development.
Booking flights, accommodations, rental cars, and activities.
Providing travel advice and information regarding destination customs, culture, and regulations.
2.4 Peaks And Palms Travel Consultants, LLC serves as an intermediary for retail travel services, facilitating arrangements through independent Third-Party Suppliers. We do not own or operate these suppliers, which include airlines, hotels, car rental companies, ground operators, tour operators, cruise lines, and other entities providing travel-related services.
2.5 While we strive to partner with reputable and high-quality suppliers, Peaks And Palms cannot assume responsibility for any issues that may arise in relation to the services provided by these independent vendors. This includes, but is not limited to:
Refunds, personal injury, property damage, or any other losses resulting from the actions or negligence of suppliers.
Deficiencies in or failures of any vehicles, equipment, or other services offered by these suppliers.
Any negligent acts or omissions by parties not directly controlled by Peaks And Palms.
2.6 Clients acknowledge that Third-Party Suppliers retain the right to alter routes, itineraries, and schedules without prior notice. As such, Peaks And Palms is not liable for any deviations, delays, cancellations, required overnight stays, missed connections, or any conditions outside our control that may affect the travel experience. Additionally, Peaks And Palms is not liable for any expenses incurred as a result of the above.
3.1 Information Accuracy: The Client agrees to provide accurate and complete information necessary for booking Travel Products. Any misinformation may result in additional fees, delays, or cancellation of travel arrangements.
3.2 Travel Documents: The Client is solely responsible for ensuring they possess valid travel documents for the destinations they intend to visit, including but not limited to:
A valid passport with at least six months' validity from the date of return.
Necessary visas for travel to and from the destinations included in the itinerary.
Any required vaccinations or health documentation.
Any other documentation required.
Furthermore, the Client is strongly encouraged to review authoritative sources, such as the Travel Warnings Section of the US State Department (www.travel.state.gov) and the Centers for Disease Control (www.cdc.gov/travel) to obtain any necessary or pertinent information about the destinations they intend to travel to. The client is explicitly advised to review entry requirements to the countries they intend to visit and ensure that they are suitable for entry. Entry requirements can vary substantially from country to country. For example, many countries will deny entry to travelers convicted of a felony, and Canada will generally deny entry to travelers convicted of DUI/DWI/etc. It is your responsibility to ensure that you are eligible for entry to the countries and destinations you intend to visit.
If you are unsure of the entry and travel requirements for the destinations you intend to visit, we recommend consulting with a Travel Attorney and reviewing the resources provided above.
Explicitly, Peaks And Palms is not liable for any additional expense incurred by the Client, or any loss of travel value, as a result of the Client not possessing valid travel documents or being denied entry to any country or destination.
3.3 Notification of Changes: The Client agrees to notify Peaks And Palms of any changes in travel plans, personal circumstances, or contact information as soon as possible.
3.4 Compliance with Laws: The Client is responsible for complying with all applicable laws and regulations in connection with their travel, including customs, immigration, and health regulations.
4.1 Booking Fees: A non-refundable booking fee may apply and will be communicated at the time of the service inquiry. This fee covers initial consultations and the time spent planning your travel itinerary. All booking fees will be presented to the client for written agreement prior to any chargeable activity taking place.
4.2 Quotes & Pricing: Clients acknowledge that pricing and inventory for Travel Products can fluctuate frequently. Quotes provided are estimates and are not guaranteed until the booking is confirmed and payment is processed. Peaks And Palms will notify Clients of any significant changes in pricing or availability prior to finalizing the booking. Clients explicitly acknowledge that Peaks And Palms is not responsible for changes in pricing or inventory prior to booking, nor for any actions taken by clients as the result of a quote prior to a booking being completed.
4.2 Payment Terms: Full payment for Travel Products may be required at the time of booking unless otherwise specified. Payments may be processed through credit cards, debit cards, or bank transfers. In some cases, partial payments may be accepted, but the Client must be aware that subsequent payments may also be non-refundable based on the policies of Third-Party Suppliers. A payment schedule, along with the refundability of such payments, will be provided to the client prior to any payment being accepted.
4.3 Non-Refundable Payments:
Certain Travel Products may require upfront payments that are non-refundable under any circumstances, including but not limited to airline tickets, hotel reservations during peak seasons, and certain tour packages.
Clients will be notified in writing if any payments made are non-refundable at the time of booking.
4.4 Currency: All prices are quoted in U.S. dollars unless otherwise stated. Clients are responsible for any additional fees incurred due to currency conversion or international transactions.
4.5 Credit Card Authorizations And Charges: Prior to payment, Peaks And Palms shall collect a credit card authorization form from Clients. This form grants Peaks And Palms express written permission to charge the Clients credit card for agreed upon travel arrangements from Third-Party suppliers and any planning or consultation fees charged by Peaks And Palms. All charges shall be presented to the client in writing for explicit approval, and written acknowledgement of charges is required by the client before Peaks And Palms shall process a charge.
4.5 Chargebacks: Except in cases of fraud, Clients agree to not file any chargeback or dispute with your bank or credit card company in conjunction with your business relationship with Peaks And Palms or any Third-Party Suppliers they contract with on your behalf. Explicitly, you agree to not use these actions as a mechanism to subvert the change or cancellation policies of Third-Party Suppliers, or any booking terms and conditions agreed to with those suppliers. Specifically, but not exclusively, changes in itinerary, destination, accommodations, travel arrangements, or activities from a Third-Party Supplier, as authorized by you under their terms and conditions, are not valid grounds for a chargeback or dispute. In the event that you initiate a chargeback, Peaks And Palms reserves the right to collect all expenses and costs incurred in relation to the chargeback process, including but not limited to attorney's fees and other associated costs.
5.1 Client Cancellations: Clients may cancel travel arrangements by notifying Peaks And Palms in writing. Cancellation fees will apply based on the individual policies of the Travel Products booked, which will be outlined at the time of booking.
5.2 Supplier Cancellations: Any cancellations or changes made by Third-Party Suppliers may affect your travel arrangements. Peaks And Palms will communicate such changes to the Client as soon as reasonably possible.
5.3 Refunds: Refunds are subject to the individual cancellation policies of the suppliers. Peaks And Palms will assist in obtaining refunds where applicable but cannot guarantee them. In cases where refunds are granted, they may be issued in the form of credits or vouchers instead of cash.
5.4 Force Majeure: Peaks And Palms is not liable for any cancellations or changes due to events beyond our control, including but not limited to natural disasters, acts of war, government actions, or pandemics. “Force Majeure” encompasses circumstances such as acts of God, terrorism, strikes, weather conditions, and other unforeseeable events that may impact travel arrangements.
6.1 Recommendation for Travel Insurance: Peaks And Palms strongly recommends that Clients purchase comprehensive travel insurance to mitigate potential risks associated with travel. This coverage can provide important protections against various travel-related uncertainties.
6.2 Coverage Benefits: Travel insurance may cover a range of scenarios, including but not limited to:
Default or bankruptcy of Third-Party Suppliers.
Trip delays, interruptions, or cancellations.
Medical emergencies, including transportation or evacuation needs.
Repatriation in the event of illness or injury.
Loss, theft, or delay of baggage and personal effects.
Accidental death or disability.
Medical expenses related to travel accidents or sickness.
6.3 Financial Protection: Proper travel insurance can protect you from significant financial losses in many situations. By choosing not to obtain travel insurance, you acknowledge and accept responsibility for any potential cancellation fees, damages, or out-of-pocket expenses that may arise.
6.4 Policy Review: If you decide to purchase travel insurance, we strongly urge you to thoroughly review the policy documentation, including the confirmation of benefits. This will detail the extent of your coverage and the procedures for filing claims.
6.5 Claims and Privacy: Please be aware that due to privacy regulations (such as HIPAA), the travel insurance provider may not be permitted to discuss your claims with Peaks And Palms. Consequently, you agree that Peaks And Palms has no control over the travel insurance provider or its coverage decisions.
6.6 Limitations of Liability: Peaks And Palms is not responsible for the performance of the travel insurance provider, including coverage determinations, claims processing, or any denial of claims. It is the Client's responsibility to understand their policy and ensure it meets their individual needs.
7.1 Clients are responsible for reviewing and validating the accuracy of all travel bookings, including names, dates, and itinerary details, immediately upon receipt of booking confirmations.
7.2 If discrepancies are identified, Clients must notify Peaks And Palms within 24 hours of receiving the confirmation to allow for timely corrections. Failure to notify us within this timeframe may result in additional fees or loss of reservations.
7.3 Ultimately, the Client is responsible for their booking and the information provided to Peaks And Palms. Peaks And Palms cannot be held responsible for incorrect travel information or details.
8.1 Peaks And Palms accepts electronic signatures as a valid form of agreement to these Terms and Conditions. By providing an electronic signature, you confirm your acceptance of this Agreement and the Services to be rendered.
8.2 Electronic communications, including confirmations and notices, will be considered valid and enforceable, equivalent to traditional written communications.
9.1 Peaks And Palms acts only as an agent for the Client in arranging travel services and is not liable for any loss, injury, or damage arising from the use of Travel Products or services provided by Third-Party Suppliers.
9.2 Peaks And Palms shall not be liable for any direct, indirect, incidental, or consequential damages arising out of or in connection with the use of our Services, including but not limited to delays, cancellations, or changes to itineraries.
9.3 The Client acknowledges that travel involves risks and may result in personal injury or death. By using our Services, the Client agrees to assume all such risks associated with travel.
10.1 This Agreement shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles.
10.2 Any disputes arising from this Agreement shall be resolved exclusively in the state or federal courts located in Salt Lake County, Utah.
11.1 Peaks And Palms reserves the right to modify these Terms and Conditions at any time. Clients will be notified of any significant changes via email or through our website.
11.2 Continued use of our Services after modifications constitutes acceptance of the new terms. Clients are encouraged to periodically review these Terms and Conditions.
12.1 If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13.1 This Agreement constitutes the entire understanding between the Client and Peaks And Palms with respect to the Services provided and supersedes all prior agreements, understandings, and representations, whether oral or written.
